§ 165.21. PERFORMANCE STANDARDS.

  • No use otherwise allowed shall be permitted within any use district which does not conform to the following standards of use, occupancy, and operation, which standards are hereby established as the minimum requirements maintained within the City.
    1. The emission of odors which are generally agreed to be obnoxious to any considerable number of persons, at their place of residence shall be prohibited.
    2. Emissions of smoke, dust, gases, and other pollutants shall not exceed Federal standards for such emissions.
    3. The emission of toxic or noxious matter shall be so controlled that no concentration at or beyond lot lines of any lot in separate ownership shall be detrimental to or endanger the public health, safety, comfort, and general welfare, or cause damage or injury to property. “Toxic or noxious matter” includes but is not limited to gases, vapors, dusts, fumes, and mists, containing properties which by chemical means are inherently harmful and likely to destroy life or impair health, or are capable of causing injury to the well-being of persons or damage to property.
